There are very specific circumstances when you can, but... this may happen;
1. If the HOA has pending litigation, the back will not lend on the home
2. Have your Realtor check with the list agent to find out about any litigation.
3. Find out if there are any special assessments being pending with the complex.
If the La Mesa condo or town-home is under litigation, you will need special financing to have the loan go through.

Banks see the litigation as a red flag and don't want to lend on something that can lose it's value. For La Mesa home buyers, it's all about risk. There are some specialized lenders that will complete a loan for these types, but the interest rates are huge and there are a lot of extra fees.
